can you use the mewtwo amiibo without the dlc like will it be unlock as a playable character

No sadly you still need to download the character. The mewtwo amiibo will activate in game after that, or before I'm not to sure I don't have it yet. But with the fact that with recent updates Mewtwo does have data in the game downloaded or not, you should be able to use the amiibo you just need to buy the character to play with him.
