Can you close the bottle without the agitator? Does it seal?

Yes, what you refer to as the agitator just snaps in place. You can take it out if you want and it will still seal. I am using mine daily to mix a powdered formula with liquid, so I like to have the agitator in place.

Bottle has scratches, It was not properly wrapped in a polybag. Highly disappointed.

I haven't used the bottle yet but when I opened the bottle it had minute scratches. It was not wrapped in a polybag. I like my things super clean and nice. Shakers looks premium though, I'll share more after 1 month usage.
